Terms & Conditions

The following terms and conditions apply and by using our services you agree to abide by and accept these terms and conditions.

1. Driving licenses and fitness to drive:

You must hold a current, valid driving license, provisional, full or international, and produce it on (or in advance of) your first training session. You must be fit to drive with regard to legal and medical requirements.

All matters relating to location, time and duration of driving tuition will be agreed between Instructor and pupil prior to lesson.

2. Payments and Cancellation:

Tuition fees are normally payable in advance. Payment can be made by cash or cheque. Any cheques offered for payment that are subsequently refused by the bank will be subject to an administration charge of £15.00.

Pupils are required to give 24 hours notice of cancellation of lessons, if this cannot be met the Instructor may forfeit the lesson or lesson cost which will be due on the next lesson

 

If either you or your instructor needs to cancel or re-arrange a lesson at least 48 hours notice will be required for single lessons of up to two hours duration. Longer lessons need a minimum of four days notice. Failure to give notice will result in a valid claim for an equivalent value in compensation (i.e., a cancellation fee will be charged or credited)

Your instructor will do everything possible to ensure that your lessons start and finish on time, but reserves the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances (e.g., dangerous weather conditions). In the event of postponement fees paid in advance will be carried forward.

The instructor reserves the right to cancel a lesson at short notice if it is suspected that the pupil may be unfit due to the effects of alcohol, drugs (prescribed or otherwise) or any other condition that would cause his/her driving to be dangerous or illegal. In such circumstances the lesson fee will be payable.

3. Bookings and Lesson duration

Your instructor will endeavor to maintain regular lesson slots at the same time each week to ensure continuity of learning, however, this cannot be guaranteed.

The minimum lesson period is one hour. If, for any reason, the instructor is late for the lesson he/she will make a concerted effort to inform the pupil of the estimated time of arrival. If the delay is greater than 15 minutes this time will be credited to the pupil and when possible the lesson will be extended by the time due – if this is not possible the extra time will be carried forward to the next suitable lesson.

4. Training Location:

All sessions will start and finish at the same location unless alternative arrangements are made in advance. The instructor will determine a location for practical lessons which ensures both the pupil’s and public safety – this means that the instructor may need to drive the pupil to and from the lesson location; this journey time forms part of the lesson as paid for.

5. Training vehicles:

Training vehicles provided by the school are taxed, insured for the purposes of driving tuition, fully roadworthy and fitted with dual controls.

Pupils who require tuition in their own vehicle must supply evidence from their motor insurer that the car is covered for lessons when being supervised by a professional instructor in return for payment; the car must also be taxed and hold a current MOT certificate where appropriate.

6. Driving tests and bookings

Your instructor reserves the right to refuse use of a driving school vehicle for test if he/she considers that provision of a vehicle could cause a risk to public safety.

Where a school car is used for test, the booking period will based upon the instructor’s normal diary schedule. Depending on the time of the test this will require a minimum two hour booking and possibly longer.

While your instructor will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, he/she cannot be held responsible for vehicle failure that occurs during the test and is not liable for consequential loss.

Your instructor cannot be held responsible for test appointments cancelled by the DSA due to bad weather, sickness, staff shortages or other reasons. Such cancellations are beyond the control of your instructor and therefore the lesson fee and ‘use of car’ fee for the booked period will be charged. Your instructor will advise about claiming compensation from the DSA .

7. Code of conduct

Your instructor agrees to abide by the conditions of the Professional Code of Conduct (a copy of which will be provided on request). In the unlikely event of complaint or dispute the guidelines of the Code of Conduct will be adhered to.

8. Your rights:

These conditions do not affect any protection a student has under consumer legislation.

We reserve the right to change or alter any of the terms and conditions without notice, but will endeavour to inform pupils of any changes as soon as possible.

 

Terms And Conditions
1.     By choosing Agnew Driving School for driving tuition the Pupil accepts the agreement between Pupil and Instructor as laid out below.
2.     The instructor will make himself, available to the pupil for the sole purpose of giving driving tuition.

4.     The lesson fee will remain the same from the first lesson.  Any changes to fees will not be passed on to existing customers.
5.     Lesson fees are payable in advance of each lesson, either at start of lesson or using online payment methods.
6.     Lesson fees are £22 per hour, 1 lesson is classed as 1 hour.
7.     Online payment will be confirmed by the Instructor to the pupil within 12 hrs of payment.

9.     Any pupil who ceases tuition with Agnew Driving School will be credited any remaining balance of lessons paid in advance.
10. The instructor will endeavour to give 48 hours notice of cancellation, or change to lesson date or time due to unforeseen circumstances.  The instructor reserves the right to postpone lessons if he feels that the road or weather conditions are not suitable or dangerous.  The instructor cannot be held responsible for any cost incurred as a result of having to postpone lessons for whatever reason.
11. The pupil will be required to provide their provisional driving licence on the first lesson, this is to ensure that pupils are licensed to drive the tuition vehicle.  Pupils must also inform the instructor of any endorsements applied to their licence during the course of tuition with Agnew Driving School.
12. The Instructor reserves the right to refuse tuition, if in the opinion of the Instructor, the pupil is unfit to drive due to alcohol, drugs, prescription medication or refusal to wear glasses or contact lenses if needed to drive.  If the above situations come into question the pupil will be charged the normal lesson fee.
13. It is the pupils responsibility to be punctual for lessons.  All lessons should be recorded to ensure that no mistakes can be made.  Where a pupil does not attend for lesson the instructor will try to contact the pupil, in the event of no contact with the pupil the instructor will wait a maximum of 15 minutes, at which point the lesson will be abandoned and the pupil will be due the normal lesson fee. (See Term 7)  A reciprocal waiting time may be required by the pupil as the Instructor may be held up for unforeseen circumstances, the Instructor will endeavour to let the pupil know at his earliest convenience, any lesson time lost will be added at the end of the lesson or will be added in lieu to a future lesson to be agreed between Instructor and pupil.

15. The instructor reserves the right to refuse any pupil access to the tuition vehicle, this will stand where a pupil has disregarded the instructors advice and has booked or not re-scheduled a practical test where the instructor feels it would be in the interests of the pupil to rebook or not to book a practical test. The fee for the day of the test is £40 more details can be found on our website.
16. The tuition vehicle will be insured for the purposes of giving driving tuition and for taking the DSA practical test.
17. Lessons may be given in a clients car at the Instructors discretion, the pupil should also be at a satisfactory standard, conditions apply:
·        The pupil must supply a valid certificate of insurance, MOT and road tax receipt for the personal vehicle, 2-3 lessons before the tuition is to be taken in private car.  The pupil should also be aware that any accident or damage to personal vehicle is not the responsibility of the Instructor and therefore cannot claim monies back relating to any incidents.
18. Nothing in these terms and conditions will reduce or affect the statutory rights of the pupil relating to faulty or mis-described goods or services.
